MakeAgent is a platform designed to simplify the creation and management of "AI Agents" that combine automation and AI capabilities. The Service allows users to connect various third-party services and utilize large language models (LLMs) to automate tasks and workflows.

3. Account Terms

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account and password.
  • You must provide accurate and complete registration information.
  • You are responsible for all activities that occur under your account and any data processed through it.
  • Use of the Service must comply with all applicable laws and regulations.

4. Subscription and Payments

Certain features of the Service may require a paid subscription.

  • Subscription details, including fees and billing cycles, will be presented at the time of purchase.
  • Payments are processed securely through third-party payment processors (e.g., Polar.sh backed by Stripe).
  • Subscriptions may automatically renew unless cancelled.
  • Refund policies, if any, will be specified at the time of purchase.
  • We reserve the right to change subscription fees upon reasonable notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Interfere with, disrupt, or place an unreasonable load on the Service or servers.
  • Transmit any worms, viruses, or code of a destructive nature.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.

7. Third-Party Services and AI Models

  • The Service integrates with various third-party services (e.g., Google, Slack, etc.) and utilizes third-party Large Language Models (LLMs).
  • Your use of connected third-party services is subject to their respective terms and privacy policies.
  • Data processed by third-party LLMs is subject to the policies of those providers (e.g., OpenAI). MakeAgent is not responsible for the data handling practices of these third parties.
  • We do not endorse and are not responsible for the content, accuracy, or practices of third-party services or AI models.

8. Intellectual Property

  • The Service, including its software, design, text, graphics, and underlying code, is the property of MakeAgent and its licensors, protected by intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable license to access and use the Service according to these Terms.
  • You retain ownership of the content and data you input into the Service ("Your Content"). You grant MakeAgent a worldwide, royalty-free license to use, reproduce, modify, adapt, and display Your Content solely for the purpose of operating, providing, and improving the Service.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

  • You may terminate your account at any time by following instructions within the Service or contacting support.
  • Upon termination, your right to use the Service will cease immediately.
  • Certain provisions, including intellectual property, disclaimers, liability limitations, and governing law, will survive termination.

10. Disclaimers and Limitation of Liability

  • The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.
  • MakeAgent does not warrant that the Service will be uninterrupted, error-free, secure, or meet your specific requirements.
  • To the fullest extent permitted by law, MakeAgent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
  • In no event shall MakeAgent's aggregate liability exceed the amount you paid MakeAgent, if any, in the past six months for the services giving rise to the claim.

11. Changes to Terms

  • We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on the Service or via email.
  • Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction where MakeAgent operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of that jurisdiction.
